Settlement Order Filed in Federal Court will Address Serious Issues at the Toa Alta Landfill in Puerto Rico

NEW YORK (August 9, 2022) – Today, the U.S Environmental Protection Agency (EPA) and the U.S. Department of Justice (DOJ) announced the filing of an interim settlement order that requires the Municipality of Toa Alta to take a series of immediate actions to address serious issues at its landfill.

The order, which needs federal judge approval, reflects the input EPA and DOJ sought from the communities impacted by the landfill during a public meeting on February 23, 2022. The settlement order would require several immediate actions by the Municipality to address urgent human health and environmental concerns at the landfill. Notably, the order would require Toa Alta to stop receiving waste, cover exposed areas of the landfill and put plans into place to manage stormwater and leachate (contaminated liquid flowing from the landfill).

"This settlement order reflects the government's efforts to engage the communities that have suffered too long due to this poorly run open dump," said Regional Administrator Lisa F. Garcia. "This order, which the Municipality has agreed to, requires the Municipality to take real action to improve landfill conditions immediately. Progress is already being made, and EPA will continue to work with the Department of Justice, the Puerto Rico government, and the Municipality to make sure these improvements are implemented to ensure the protection of public health and that the eventual permanent closure of this landfill is done properly."

More specifically, the order would require the Municipality of Toa Alta to:

• Provide immediate and unimpeded access to the landfill to EPA and Puerto Rico  
• Ensure that all areas of exposed waste are covered by daily cover (a term defined in the proposed order).
• Stop all waste disposal at the landfill, with possible exceptions if allowed or required as part of a revised permanent closure plan for the landfill prepared in accordance with Puerto Rico regulations and approved by DNER.  
• Install signs in Spanish and English stating the landfill is closed.  
• Stabilize the North Slope area by implementing stormwater control and other measures.

• Cover the landfill with "intermediate cover" at the rate of one acre per month period during the first year commencing October 1, 2022, and two acres per month thereafter until the entire Landfill has been covered.
• Develop a leachate management plan by October 1, 2022 and implement it.
• Develop a stormwater management plan by January 1, 2023 and implement it.

The order also includes reporting requirements Toa Alta must follow so that EPA can maintain oversight and keep the community informed of developments at or concerning the landfill. 

The Municipality of Toa Alta has been operating its solid waste landfill since 1966. A majority of the landfill does not have a bottom protective liner and therefore is considered to be an "open dump." Regulations require that all open dumps be closed by 1998 and that all landfills be appropriately operated, including daily and intermediate cover, leachate collection, and landfill gas and stormwater controls. In Puerto Rico, the Department of Natural and Environmental Resources is directly responsible for requiring compliance with landfill regulations. At the same time, the EPA has separate authorities to address urgent risks to public health and the environment at landfills. 

In February 2021, DOJ filed a complaint in the Federal Court against Toa Alta on behalf of EPA, claiming that the conditions at the landfill constitute an "imminent and substantial endangerment." In July 2021, DOJ filed a request that the Federal Court issue an order requiring Toa Alta to address various urgent problems at the landfill immediately. In September 2021, DNER filed an administrative complaint against Toa Alta. Finally, in October 2021, DNER announced a plan to address the "open dumps" in Puerto Rico, including Toa Alta.

From February to March 2022, EPA and DOJ sought public comments from residents to get feedback on potential terms of an interim settlement order before finalizing negotiations with the Municipality. EPA hosted a public meeting in Toa Alta on February 23, 2022, which included representatives of EPA, DNER, DOJ, and the Mayor of Toa Alta.

The Municipality has since informed EPA and DOJ that it has stopped disposing waste at the landfill as of April 2022, and as of June continues to take action to meet the terms of the proposed preliminary injunction order in advance of the official filing of the order with the Court.

Orden de Acuerdo Provisional presentada en tribunal federal atenderá problemas ambientales serios en el

vertedero de Toa Alta en Puerto Rico

NUEVA YORK (9 de agosto de 2022) – Hoy, la Agencia de Protección Ambiental de los Estados Unidos (EPA, por sus siglas en inglés) y el Departamento de Justicia de los Estados Unidos (DOJ) anunciaron la presentación de una orden de acuerdo provisional que exige que el Municipio de Toa Alta tome una serie de acciones inmediatas para atender los problemas ambientales graves que tiene su vertedero.

La orden, que necesita la aprobación de un juez federal, refleja la colaboración de la EPA y el DOJ que buscaron el insumo de las comunidades afectadas por el vertedero durante una reunión pública el 23 de febrero de 2022.  La orden de acuerdo provisional requerirá varias medidas inmediatas por parte del Municipio para atender las preocupaciones urgentes de salud humana y ambientales en el vertedero.  En particular, la orden requeriría que Toa Alta deje de recibir residuos sólidos, cubra las áreas expuestas del vertedero y ponga en marcha planes para administrar las aguas de escorrentías y los lixiviados (los líquidos contaminados que fluyen desde el vertedero).

"Esta orden de acuerdo provisional refleja los esfuerzos del gobierno para integrar la participación y el insumo de las comunidades que han sufrido demasiado tiempo debido a este vertedero mal administrado", señaló la administradora regional Lisa F. García.  "Esta orden, que el Municipio ha aceptado, requiere que el Municipio tome medidas concretas para mejorar inmediatamente las condiciones del vertedero.  Ya se están haciendo progresos, y la EPA continuará trabajando con el Departamento de Justicia, el gobierno de Puerto Rico y el Municipio para asegurarse de que estas mejoras se implementen a fin de garantizar la protección de la salud pública y que el eventual cierre permanente de este vertedero se realice correctamente".

Específicamente, la orden de acuerdo provisional requerirá que el Municipio de Toa Alta:

• Proporcione acceso inmediato y sin obstáculos al vertedero a la EPA y al gobierno de Puerto Rico
• Se asegure de que todas las áreas de residuos expuestos se le aplique cubierta diaria (un término definido en la orden propuesta).
• Se detenga el depósito de residuos sólidos en el vertedero, con posibles excepciones si se permite o se requiere como parte de un plan de cierre permanente revisado para el vertedero preparado de acuerdo con la reglamentación de Puerto Rico y aprobado por el DRNA.
• Instale letreros en español e inglés que indiquen que el vertedero está cerrado.
• Estabilice el área de la ladera norte mediante la implementación de control de aguas de escorrentía y otras medidas.
• Cubrir el relleno sanitario con "cubierta intermedia" a razón de un acre por período mensual durante el primer año que comienza el 1 de octubre de 2022, y dos acres al mes a partir de entonces hasta que se haya cubierto todo el vertedero.
• Desarrolle un plan de manejo de lixiviados para el 1 de octubre de 2022 y lo implemente.
• Desarrolle un plan de manejo de aguas de escorrentía para el 1 de enero de 2023 y lo implemente.

La orden también incluye los requisitos de informes que el Municipio de Toa Alta debe someter para que la EPA pueda continuar la supervisión y mantener a la comunidad informada de los acontecimientos en o con respecto al manejo del vertedero.

El Municipio de Toa Alta ha estado operando su vertedero de residuos sólidos desde 1966. La mayor parte del vertedero no tiene un revestimiento protector inferior y, por lo tanto, se considera un "vertedero abierto". Las regulaciones requieren que todos los vertederos abiertos se cierren para 1998 y que todos ellos sean operados adecuadamente, incluyendo la cobertura diaria e intermedia, la recolección de lixiviados y los controles de gases y aguas de escorrentía de los vertederos. En Puerto Rico, el Departamento de Recursos Naturales y Ambientales es directamente la agencia responsable de exigir el cumplimiento de las reglamentaciones sobre de vertederos. Al mismo tiempo, la EPA tiene facultades separadas a fin de atender los riesgos inminentes para la salud pública y el medioambiente en los vertederos.

En febrero de 2021, el Departamento de Justicia presentó una denuncia en el Tribunal Federal contra el Municipio de Toa Alta en nombre de la EPA, alegando que las condiciones en el vertedero constituyen un "peligro inminente y sustancial". En julio de 2021, el Departamento de Justicia presentó una solicitud para que el Tribunal Federal emitiera una orden exigiendo que Toa Alta atendiera inmediatamente varios problemas urgentes en el vertedero. En septiembre de 2021, el DRNA presentó una orden administrativa contra Toa Alta. Finalmente, en octubre de 2021, el DRNA anunció un plan para atender el cierre de vertederos en Puerto Rico, incluido el de Toa Alta.

De febrero a marzo de 2022, la EPA y el DOJ procuraron obtener comentarios públicos de los residentes para recibir las opiniones y recomendaciones sobre los posibles términos de una orden de acuerdo provisional antes de finalizar las negociaciones con el Municipio. La EPA organizó una reunión pública en Toa Alta el 23 de febrero de 2022, que incluyó a representantes de la EPA, el DRNA, el DOJ y el Alcalde de Toa Alta.

Desde entonces, el Municipio ha informado a la EPA y al DOJ que ha dejado de depositar residuos sólidos en el vertedero desde abril de 2022, y a partir de junio continúa tomando medidas para cumplir con los términos de la orden judicial preliminar propuesta antes de la presentación oficial de la orden ante el Tribunal.
